Terms & Conditions – BRAMIDAN Certify

 

1. Introduction

These Terms & Conditions govern the use of the BRAMIDAN Certify platform, provided by Bramidan A/S ("Bramidan", "we", "us", or "our").

BRAMIDAN Certify is a digital training and certification platform designed to support training and documentation for machine operators.

By accessing or using the platform, the customer (employer) and users agree to these Terms & Conditions.

 

2. Use of the Platform

The platform is intended for:

  • Training of machine operators
  • Completion of digital training courses
  • Documentation of completed training

Users must:

  • Provide accurate and truthful information
  • Use the platform solely for its intended purpose
  • Keep login credentials confidential and not share them with others

The platform is a digital tool and must only be used in accordance with applicable instructions and local safety procedures.

 

3. User Accounts

Access to the platform requires a user account.

Users are responsible for:

  • Keeping login credentials secure
  • All activity performed under their account

The customer (employer) is responsible for:

  • Assigning users to the platform
  • Ensuring that only relevant employees are given access
  • Maintaining correct and up‑to‑date user information

Bramidan reserves the right to suspend or terminate user accounts in case of misuse, security concerns, or breach of these Terms & Conditions.

 

4. Training and Authorization

BRAMIDAN Certify provides digital training material based on:

  • Bramidan machine operation guidelines
  • Standardised training materials

Completion of a course may result in a certificate.

Certificates issued via BRAMIDAN Certify document that the user has completed the relevant digital training material made available on the platform.

Certificates:

  • Do not constitute legal compliance, regulatory approval, or an official professional qualification
  • Do not replace mandatory on‑site instruction, supervision, or workplace‑specific risk assessments

The customer remains fully responsible for:

  • Compliance with applicable health, safety, and working environment legislation
  • Ensuring that users are adequately instructed, supervised, and qualified for machine operation
  • Assessing whether training documentation is sufficient for authority inspections, audits, or internal compliance purposes

Bramidan does not guarantee that certificates generated via the platform will be accepted by authorities or third parties as sufficient documentation.

 

5. Availability

Bramidan aims to ensure high availability of the platform. However:

  • The platform is provided “as is”
  • Uninterrupted or error‑free access is not guaranteed
  • Planned maintenance, updates, or technical issues may temporarily affect availability
 

6. Intellectual Property

All content on the platform, including training materials, videos, texts, graphics, and certificates, is the property of Bramidan A/S or its licensors.

Users may not:

  • Copy, distribute, modify, or reuse content
  • Use platform content outside the platform without explicit written permission from Bramidan
 

7. Data Protection

For the purposes of applicable data protection legislation, including Regulation (EU) 2016/679 (GDPR):

  • The Customer acts as Data Controller
  • Bramidan A/S acts as Data Processor

Bramidan processes personal data solely on behalf of and in accordance with the documented instructions of the Customer.

Processing of personal data is governed by a Data Processing Agreement (DPA) entered into between Bramidan and the Customer. The DPA forms an integral part of these Terms & Conditions.

In the event of any conflict between these Terms & Conditions and the DPA, the provisions of the DPA shall prevail with respect to personal data processing.

8. Limitation of Liability

Bramidan shall be liable in accordance with Danish law, subject to the limitations set out below.

Bramidan’s total aggregate liability arising out of or in connection with the use of the platform shall, for any twelve (12) month period, be limited to the fees paid by the Customer for the BRAMIDAN Certify platform during that period.

Bramidan shall not be liable for:

  • Indirect or consequential losses, including loss of profit, loss of production, or loss of data
  • Losses caused by misuse of the platform or incorrect use of machines
  • Compliance with occupational health and safety legislation or authority requirements

Nothing in these Terms & Conditions shall exclude or limit liability for:

  • Gross negligence or wilful misconduct
  • Liability that cannot be excluded under mandatory Danish law, including applicable product liability

The platform serves solely as a digital support tool for training and documentation and does not replace employer responsibilities, on‑site instruction, or legally required safety measures.

 

9. Changes to the Platform and Terms

Bramidan may update the platform and amend these Terms & Conditions from time to time.

The applicable version will always be available on the platform, and continued use constitutes acceptance of the updated terms.

 

10. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with Danish law, without regard to conflict of law principles.

 

11. Jurisdiction and Contact

Any dispute arising out of or in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the Danish courts, with venue at Esbjerg District Court, unless mandatory law provides otherwise.
